Sister Safe

For purposes of these Terms, the following capitalized terms shall have the meanings set forth below, whether used in the singular or the plural:

• “Company,” “we,” “us,” or “our” means Pitch Marketing LLC-FZ, a limited liability company established in a free zone of Dubai, United Arab Emirates, with its registered office at 6th Floor, Business Center 1, Meydan Hotel, Nad Al Sheba, Dubai, United Arab Emirates, together with its officers, directors, employees, contractors, licensors, and affiliates.
• “Service” means, collectively, the Sister Safe mobile application, the sistersafe.io website, the alert-viewer web pages, the administrative tools, and any related features, content, and functionality made available by the Company, including any updates, upgrades, or new versions thereof.
• “User,” “you,” or “your” means any individual who creates an Account, accesses, browses, or otherwise uses the Service in any capacity.
• “Account” means the anonymous, username-based profile a User establishes to access the Service, associated with a dedicated, User-supplied email address as described in Section 3.
• “Safety Session” means a timed check-in workflow initiated by a User (referred to in parts of the Service interface as a “Date”) during which the User is expected to enter a code at scheduled intervals to indicate their continued safety and well-being.
• “Safety Alert” or “Duress Event” means any automated notification, escalation, or incident record generated by the Service as a result of a missed, incorrect, or duress-indicating check-in, all-clear code, or related input during a Safety Session.
• “Safe Contact” means an individual designated by a User to receive Safety Alerts and related information in connection with that User’s Safety Sessions.
• “Counterparty” means the individual profile of a date or other third party about whom a User submits, links, browses, reviews, or otherwise interacts with information through the Service (displayed in the Service as “Date” or “Date Information”), including social media application handles, contribution records, or review content.
• “View My Data Service” means the paid, human- and/or artificial-intelligence-assisted data-matching service described in Section 12, by which a person may request the release of anonymously stored information that may correspond to them.
• “Health Contact Tracing Service” means the optional, subscription-based anonymous health-exposure notification feature described in Section 13.
• “User Content” means any data, text, images, video, audio, location information, social media links, contact information, or other material submitted, uploaded, recorded, or transmitted by a User through the Service.
• “Applicable Law” means all statutes, regulations, decrees, treaties, and binding governmental or regulatory guidance applicable to the Company, the Service, or a User, including without limitation the laws of the United Arab Emirates and the Kingdom of Thailand.

The Service does not identify Users and does not verify age. The Company considers access to personal-safety reporting and Safety Alerts to be important for individuals of any age, including minors, and does not impose a minimum age to create an Account or use the core safety features of the Service (Safety Sessions, Safety Alerts, Safe Contacts, and Counterparty browsing/reporting).

If you are under the age of eighteen (18), you must designate a parent, legal guardian, and/or the police as at least one of your Safe Contacts, so that a responsible adult or the appropriate authority is able to receive any Safety Alert generated on your behalf. You are solely responsible for making and keeping this designation accurate. The Company does not independently verify a User’s age or verify that a designated Safe Contact is in fact a parent, legal guardian, or police contact, and relies on each User to comply with this Section in good faith.

Certain features of the Service remain separately restricted to Users eighteen (18) years of age or older: (i) Date Counterparty profile fields, browsing, and search that request or display age information, consistent with the Company’s existing product rules for that feature; and (ii) acting as the paying party for a fee-based feature under Section 12 (View My Data Service) or Section 13 (Health Contact Tracing Service subscription), where Applicable Law requires legal capacity to contract. A minor who wishes to use those specific fee-based features must do so with the involvement of a parent or legal guardian who can lawfully complete the payment.

By creating an Account, you represent and warrant that: (a) you have the legal right, power, and capacity to use the Service consistent with this Section, including the Safe Contact designation required of minors above; (b) you are not barred from using the Service under the laws of the United Arab Emirates, the Kingdom of Thailand, your country of residence, or your country of citizenship; (c) you are not located in, organized under the laws of, or a resident of any jurisdiction that is subject to comprehensive United Arab Emirates, United States, European Union, or United Nations sanctions or embargo; and (d) all information you provide to the Company in connection with your Account, whether or not it identifies you personally, is truthful, current, and provided in good faith. The Company reserves the right, in its sole and absolute discretion, to refuse Service to any person, to request additional information to verify compliance with this Section, and to suspend or terminate any Account that it reasonably believes was created or is being used in violation of this Section.

The Service is designed to allow Users to interact anonymously by way of a self-selected username. The Company does not require government-issued identification, legal name, or other directly identifying documentation to create or operate an Account for ordinary safety features. However, an Account cannot be created or maintained without a valid, User-controlled email address, which the Company uses solely for account verification, security notices, password recovery, and the transactional communications described in Section 12 and Section 13.

You are strongly advised, and it is your sole responsibility, to create and use an email address for the Service that you do not use for any other website, application, social media account, or service.

If you provide, or have previously used, an email address that is also associated with other online accounts, services, marketing lists, data broker records, or previously breached datasets, that email address may itself function as a unique identifier that can be cross-referenced, correlated, or matched against other data sources by third parties, including but not limited to advertisers, data aggregators, and malicious actors in the event of a data breach affecting the Company or any third party. The anonymity the Service is designed to provide is a function of the Company’s data-handling practices described in the Privacy Policy and is not, and cannot be, a guarantee against re-identification arising from your own reuse of identifying information such as an email address, phone number, photograph, or social media handle across multiple contexts. You expressly acknowledge and accept this risk as a condition of using the Service.

You are solely responsible for maintaining the confidentiality of your Account credentials, for all activity that occurs under your Account, and for promptly notifying the Company of any unauthorized use. The Company is not liable for any loss or damage arising from your failure to safeguard your Account credentials or your dedicated email address.

The Service provides tools intended to help Users reduce certain personal-safety risks, including without limitation: (a) timed Safety Sessions with check-in codes and an all-clear code; (b) automated Safety Alerts to designated Safe Contacts by push notification, email, and other channels when a check-in is missed or a duress condition is detected; (c) optional location sharing during an active Safety Session; (d) optional audio recording during a User-initiated event, as described in Section 8; (e) browsing and review of Counterparty profiles submitted by other Users; (f) the View My Data Service described in Section 12; and (g) the Health Contact Tracing Service described in Section 13. The specific features available to you may vary based on your device, jurisdiction, subscription status, and the Company’s ongoing development of the Service.

The Service is a risk-mitigation and communication tool. It is not a substitute for calling emergency services, for personal judgment, or for the physical presence of another person, and it does not create any duty of rescue, guardianship, or protective relationship between the Company and any User, Safe Contact, or third party.

No application, website, or software system, including the service, can guarantee your safety, prevent harm, or ensure that any emergency will be detected, reported, or responded to in time. The company makes no representation or warranty, express or implied, that use of the service will prevent, reduce, or eliminate any risk of injury, assault, abduction, death, or any other harm.

All features of the Service, including without limitation Safety Sessions, Safety Alerts, location sharing, audio recording, push notifications, email delivery, and any escalation to Safe Contacts, law enforcement, or other third parties, are provided strictly on a best-efforts basis and are subject to circumstances beyond the Company’s control, including without limitation: cellular and internet network availability and latency; device battery life, hardware failure, and operating-system restrictions; third-party push-notification, email, and telecommunications provider outages or filtering; the User’s own failure to grant or maintain necessary device permissions; the responsiveness, availability, and conduct of Safe Contacts, who are third parties over whom the Company has no control; and force majeure events described in Section 24.

You expressly acknowledge that any specific timing, cadence, or feature described in the Service’s user interface or documentation (for example, a stated location-update interval or notification-repeat interval) reflects an intended target only and is not a guaranteed or warranted performance specification. You must always maintain independent, non-Service safety precautions appropriate to your circumstances, including but not limited to informing trusted persons of your plans through means outside the Service, carrying independent means of contacting emergency services, and exercising your own judgment about any situation you enter. The Service supplements, and does not replace, your own vigilance and judgment.

By using the service, you voluntarily and knowingly assume all risks associated with such use, whether foreseeable or unforeseeable, including risks arising from the company’s own negligence to the maximum extent permitted by applicable law.

Without limiting the foregoing, you specifically assume the risk that: (a) a Safety Alert may not be generated, delivered, or acted upon in time, or at all; (b) a Safe Contact may not receive, notice, understand, or respond to a Safety Alert; (c) location data may be delayed, inaccurate, unavailable, or entirely absent at the moment it is needed; (d) audio recording may fail to start, may stop prematurely, or may not be usable as evidence; (e) any human or automated matching, review, or moderation process may produce an incorrect, incomplete, or delayed result; (f) information you or another User submits about a Counterparty may be inaccurate, outdated, incomplete, defamatory, or unlawful, and the Company does not independently verify User Content before or after publication; and (g) meeting, communicating with, or otherwise interacting with any person you encounter directly or indirectly through the Service carries inherent personal risk that exists independently of the Service and that the Service cannot eliminate. This assumption of risk supplements, and does not limit, the disclaimers and limitations of liability set out elsewhere in these Terms.

7.1 The First Alert: Preset Information, Description, Images, and Location. If you do not enter your check-in code (or your all-clear code) correctly within the interval you configured for a Safety Session, the Service treats this as a missed check-in and publishes the first Safety Alert to that Safety Session's incident record. This first Safety Alert makes the following available, immediately, on the alert-viewer webpage and in the corresponding in-application alert object made available to your Safe Contacts: the preset information you configured for the Safety Session (including your Date description and, where you enabled them, your Counterparty information and other details you chose to share); any photographs, screenshots, or description images already uploaded for that Safety Session; and your location data, which begins updating from this first alert onward.

7.2 The Second Missed Check-In: Audio Is Added, and Location Continues to Refresh. If a second consecutive check-in interval is missed for the same Safety Session, the Service additionally makes available, on the same alert-viewer webpage and in-application alert object, any audio recording associated with that Safety Session, consistent with the audio-sharing setting you selected at setup (either your Safe Contacts, or, if you selected that option, only through the police-facing release path). From the second missed check-in onward and until the Safety Alert is cleared under Section 7.3 or Section 7.5, both the location data and the audio continue to update with fresh information as it becomes available, rather than being a single static snapshot. As explained in Section 8, audio recording and its delivery remain best-efforts only.

7.3 A Correct Code Stops the Alert. Entering the correct check-in code before an interval expires satisfies that check-in without escalation. Entering the correct all-clear code at any point — including after a Safety Alert has already been generated for that Safety Session — marks the Safety Session as safe and resolves any open Safety Alert associated with it, notifying your Safe Contacts that the alert has been resolved.

7.4 Incorrect Codes Appear Accepted But Silently Trigger a Safety Alert. If you enter an incorrect check-in or all-clear code, the application deliberately displays the same normal, accepted-looking response you would see if the code were correct, while the Service silently records the incorrect entry as a duress indication and generates or continues a Safety Alert in the background. This design exists so that if you are being forced to clear an alert or falsify a check-in under duress, you can deliberately enter an incorrect code to trigger a Safety Alert while the device continues to show the person compelling you that a normal, correct code was accepted. Nothing on the device's visible screen, local notification, or displayed timer state discloses that a Safety Alert has been triggered by an incorrect code.

7.5 Recovery Once an Alert Has Been Triggered. Once a Safety Alert has been generated for a Safety Session, in all circumstances only a person holding the alert-viewer link and its separate numeric view code (an authorized incident viewer, ordinarily one of your Safe Contacts) can open the alert-viewer webpage for that incident. From that webpage, an authorized incident viewer must first acknowledge the alert and may then request a one-time code reset. That request causes the Service to generate a new, time-limited recovery code and deliver it only by email to the email address on file for the Account that owns the Safety Session — not to the viewer. The viewer must separately confirm, from the same webpage, that the person is safe before that recovery code becomes usable. The Account owner (the person who may be under duress) can then enter the emailed recovery code in the application to resolve the Safety Alert, in the same way described in Section 7.3. This recovery path exists specifically for situations in which the original check-in or all-clear code cannot safely or successfully be used to clear an already-triggered alert.

During an active Safety Session, the Service may collect and transmit approximate or precise location data at intervals, subject to the release rules above. You control whether location sharing, audio recording, and incident-capture features are enabled for a given Safety Session through the settings available in the application; deactivating a feature reduces the information available to your Safe Contacts and to the Company in the event of a Safety Alert. You are solely responsible for the security and correct use of your codes, and the Company is not responsible for any consequence arising from a code being independently discovered by, or otherwise obtained by, a third party.

The Service may allow you to explicitly enable audio recording in connection with a User-initiated Safety Session or Safety Alert event. Where enabled, recording is intended to continue until you affirmatively end the event, subject to the limitations below. Audio recording is not guaranteed and is offered strictly on a best-efforts basis. Recording may fail, be interrupted, be truncated, or not occur at all due to operating-system background-execution limits, application-store platform policies, insufficient storage, network unavailability affecting upload, device battery depletion, microphone hardware or permission issues, or other technical constraints outside the Company’s control. You are solely responsible for ensuring that your use of the audio-recording feature complies with the consent and recording laws of every jurisdiction in which you record, including any requirement to obtain the consent of other recorded parties, and the Company disclaims all liability for your failure to do so.

You acknowledge and agree that the Company may access, preserve, and disclose User Content, Account information, location data, audio recordings, and any other data associated with your use of the Service to police, prosecutorial, judicial, or other government authorities: (a) in response to a valid official request, subpoena, court order, warrant, or other compulsory legal process; or (b) on an expedited, pre-official-process basis, where a User, a Safe Contact, or an authorized incident viewer provides explicit in-application consent for such faster release — for example, and without limitation, during a genuine emergency or duress alert where locating a User quickly may protect their safety, and where waiting for a formal legal request could cause harm or delay that defeats the purpose of the disclosure. The Company may also disclose such information voluntarily where it forms a good-faith belief that disclosure is necessary to prevent death, serious bodily harm, or an ongoing crime, or to comply with Applicable Law.

You further acknowledge that the Company may disclose or preserve data in response to requests from authorities in any jurisdiction connected to the User, the Counterparty, the alleged incident, or the Company itself, and that no prior notice to you is guaranteed before such disclosure where notice is prohibited by law, would defeat the purpose of an emergency disclosure, or is otherwise not reasonably practicable.

You retain any ownership rights you may have in User Content you submit. By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, transmit, display, and otherwise use that User Content solely as necessary to operate, provide, secure, and improve the Service, including sharing it with Safe Contacts, authorized incident viewers, the View My Data Service matching process, and, where required, law enforcement or other government authorities as described in Section 9.

You represent and warrant that you own or have all necessary rights, licenses, and consents to submit any User Content, including any photograph, video, recording, screenshot, or personal information relating to a Counterparty or any other third party, and that your submission and the Company’s use of it as described in these Terms does not and will not violate any Applicable Law or any right of any third party, including privacy, publicity, defamation, or intellectual-property rights. The Company does not pre-screen User Content and is not responsible for its accuracy, legality, or appropriateness, but reserves the right, without obligation, to remove or restrict access to any User Content at its discretion, including in response to a report or a legal request.

The Service allows Users to submit, browse, and review information about Counterparties, including social-media application handles, contribution records, and structured review content. The Company does not verify the identity of any Counterparty, the accuracy of any submitted information, or the truthfulness of any review. All such content reflects the statements and opinions of the submitting User alone, not the Company, and the Company expressly disclaims any endorsement, verification, or adoption of it. You are solely responsible for exercising independent judgment before relying on any Counterparty information, and you assume all risk associated with your reliance on User-submitted Counterparty information, as set out further in Section 6.

You agree not to submit information about a Counterparty that you know to be false, that is submitted with an intent to harass, defame, or unlawfully harm another person, or that violates any Counterparty’s rights under Applicable Law. The Company reserves the right to investigate reports of misuse, remove content, and suspend or terminate Accounts associated with abusive submissions, and may cooperate with law enforcement in connection with any report of unlawful use of this feature, consistent with Section 9.

Because the Service does not associate uploaded Counterparty information (including images, screenshots, social-media links, and contact details) with any verified identity, the Company cannot, on its own, determine whether any stored data relates to a particular person. The View My Data Service is an optional, fee-based mechanism by which a person may request that the Company attempt to locate and release information that may have been submitted about them.

To use the View My Data Service, you must submit matching information about yourself, which may include social-media handles and profile links, telephone or messaging contact identifiers, and photographs or a short video of yourself. You are not required to submit government identification or otherwise prove your legal identity. The Company, using a combination of human review and automated tools, including facial-recognition-assisted comparison, will attempt to match your submitted information against anonymously stored Counterparty data and will present you with the data reasonably determined to correspond to your submission.

The View My Data Service is a paid service. The applicable fee is published on the website at the time of your request and may be revised by the Company from time to time; the fee that applies is the fee displayed at the time you submit your request. You must provide payment information to complete your request. Because payment processing necessarily identifies the payer, your use of this Service may link your payment identity to the search you conducted, even though the underlying Counterparty data itself remains stored without a verified owner. To minimize this exposure, the Company deletes the association between your search request, your submitted matching information, and the released report immediately after the result has been delivered to you, so that no continuing record links your payment information to the anonymously stored data after your request is complete. This deletion is a privacy-protective measure and does not entitle you to a refund, re-run, or reconstruction of a completed request.

You acknowledge that any match presented to you is a probabilistic determination, not a certainty, and that the Company does not warrant the completeness, accuracy, or exhaustiveness of any released data or matching result. Additional searches, expanded criteria, or repeat requests may incur additional fees as published on the website.

13.1 Overview and Opt-In Nature. The Health Contact Tracing Service is an entirely optional feature that a User may choose to activate. Activation requires an email address to link the subscription to your Account and to deliver alerts, but does not require identity verification. If you do not opt in, you will not receive or contribute to Health Contact Tracing Service functionality.

13.2 What Is a “Contact Chain.” A health condition may be carried and transmitted by a person for a period of weeks or months before that person becomes aware they are a carrier. During that period, the carrier may interact with other people, who may in turn interact with still other people, forming an extended chain of contact of which no individual in the chain may be aware at the time. The Health Contact Tracing Service uses anonymized, self-reported linkage data supplied by subscribing Users to identify other subscribing Users who may fall within such a contact chain relative to a self-reported positive result.

13.3 Self-Reporting and Anonymity. A User may self-report a health condition result entirely anonymously. No information identifying the reporting User is disclosed to any other User at any point in the process. Alerts are addressed only to the email address and, where applicable, the payment method on file for the recipient subscriber, and never identify or imply the identity of the reporting User.

13.4 Contact-Chain Alert Content. Where a self-reported result relates to HIV or syphilis, an alerted subscriber will be informed of the specific condition identified within their contact chain, together with the ninety (90) day exposure window described in Section 13.5. For any other health condition supported by the Service, an alerted subscriber will receive only a generic notice substantially in the form: “Health alert received from your contact chain,” without further specification of the condition, in order to balance actionable public-health notice with the privacy of the reporting User.

13.5 Ninety-Day Contact Window (HIV and Syphilis). For HIV and syphilis, the Service applies a rolling ninety (90) day contact window: when a positive result is self-reported, subscribers who fall within the contact chain during the preceding ninety (90) days are eligible to be alerted. Because a self-report may reference contact occurring at any point within that window, and because alerts are only generated and delivered to subscribers who are actively subscribed at the time an alert is processed, a lapse in your subscription of even one (1) day may cause you not to receive an alert relating to contact that occurred at any point during the entire preceding ninety (90) day period. In other words, a single-day lapse carries the same practical exposure risk as a full ninety (90) day lapse, because you cannot retroactively receive alerts for the period during which you were not an active subscriber. You are solely responsible for maintaining continuous, uninterrupted subscription status if you wish to minimize this risk, and the Company has no obligation to notify you of a lapse before it occurs or to reconstruct missed alerts after your subscription is reinstated.

13.6 Fees; Thailand Citizenship Exemption. The Health Contact Tracing Service is provided free of charge to Users who upload satisfactory proof of Thailand citizenship, as determined by the Company in its reasonable discretion. Users who do not provide such proof are subject to a subscription fee, as published on the website, for the period of their subscription. Only new alerts generated during an active subscription period will be delivered; no alerts will be generated or delivered for any period during which a subscription has lapsed, consistent with Section 13.5.

13.7 No Diagnostic or Medical Guarantee. The Health Contact Tracing Service is a notification tool based on self-reported, unverified information from other Users. It is not a medical device, diagnostic service, or substitute for professional medical testing, advice, or treatment. The Company does not verify the accuracy of any self-reported result and disclaims all liability for any missed, delayed, false, or inaccurate alert, and for any health outcome associated with reliance on this Service in lieu of independent medical testing and advice.

The core personal-safety functionality of the Service — including Safety Sessions, Safety Alerts, Safe Contacts, and Counterparty browsing and reviews — is provided to Users free of charge. The Company reserves the right to introduce, modify, or discontinue free features at any time, subject to Section 22. The View My Data Service (Section 12) and the Health Contact Tracing Service (Section 13, other than for Users with an approved Thailand-citizenship exemption) are fee-based, and applicable fees are published on the website and may change from time to time. All fees are stated and payable in the currency and through the payment method indicated at checkout, are non-refundable except as required by Applicable Law or expressly stated in these Terms, and are exclusive of any applicable taxes, which you are responsible for unless otherwise stated.

The Company does not sell your personal data to third parties. Fees charged for the View My Data Service and the Health Contact Tracing Service compensate the Company for the operational cost of the human review, matching infrastructure, notification infrastructure, and payment processing associated with those services, and do not represent, and must not be construed as, a sale of personal data.

In addition to any other restriction in these Terms, you agree not to: (a) submit false, misleading, harassing, defamatory, or unlawful User Content, including false Counterparty reviews or false health self-reports; (b) use the Service to stalk, surveil without consent, threaten, or endanger any person; (c) attempt to identify, or assist any third party in identifying, the source of an anonymous Health Contact Tracing Service alert or any other anonymous submission; (d) circumvent, disable, or interfere with any security, rate-limiting, authentication, or anonymization feature of the Service; (e) use automated means to scrape, extract, or bulk-download data from the Service without the Company’s prior written consent; (f) reverse-engineer, decompile, or attempt to derive the source code of the Service except to the extent such restriction is prohibited by Applicable Law; (g) impersonate any person or entity or misrepresent your affiliation with any person or entity; or (h) use the Service in violation of any Applicable Law, including laws governing recording consent, data protection, harassment, or public health reporting.

The Service, including its software, design, text, graphics, logos, and the “Sister Safe” name and marks, is owned by the Company or its licensors and is protected by copyright, trademark, and other intellectual-property laws of the United Arab Emirates and other jurisdictions. Except for the limited license expressly granted to you to access and use the Service for its intended personal, non-commercial purpose, no right, title, or interest in the Service is transferred to you. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without the Company’s prior written consent.

The Service relies on and may link to third-party infrastructure and services, including email delivery providers, push-notification providers, mapping and geolocation providers, cloud storage and content-delivery providers, and payment processors. The Company is not responsible for the availability, content, security practices, or acts or omissions of any third-party service, and your use of any such third-party service may be subject to that third party’s own terms and privacy policy, which you should review independently.

To the maximum extent permitted by applicable law, the service, including all content, features, and functionality made available through it, is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

Without limiting the foregoing, the company does not warrant that: (a) the service will meet your requirements or expectations; (b) any safety session, safety alert, location share, audio recording, notification, or emergency escalation will function, will be timely, or will achieve any particular outcome; (c) any counterparty information, review, view my data service result, or health contact tracing service alert will be accurate, complete, or current; (d) the service will be uninterrupted, secure, or free of viruses or other harmful components; or (e) any defect will be corrected. No advice or information, whether oral or written, obtained from the company or through the service, creates any warranty not expressly stated in these terms.

The Service does not provide medical, legal, psychological, security, or law-enforcement advice of any kind, and nothing in the Service should be construed as such advice. You should consult appropriately qualified professionals for guidance specific to your situation.

To the maximum extent permitted by applicable law, in no event shall the company be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for personal injury, wrongful death, emotional distress, loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your access to or use of, or inability to access or use, the service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the company has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the company’s total cumulative liability to you for all claims arising out of or relating to the service shall not exceed the greater of (a) the total amount of fees, if any, that you paid to the company for the view my data service or the health contact tracing service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred united states dollars (usd 100). because the core safety features of the service are provided free of charge, this cap will in most cases be nominal, and you acknowledge that this allocation of risk is an essential basis of the bargain between you and the company and that the service would not be offered on a free or low-cost basis without such limitation.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Applicable Law, including liability for death or personal injury caused by the Company’s gross negligence or willful misconduct, or liability for fraud, to the extent such exclusion or limitation is prohibited by the mandatory law of a jurisdiction that applies to you notwithstanding Section 23. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you in full; in such case, the Company’s liability shall be limited to the minimum extent permitted under such Applicable Law.

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, contractors, licensors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or any Applicable Law; (c) any User Content you submit, including Counterparty information, reviews, or health self-reports; (d) your violation of any right of any third party, including a Counterparty or a Safe Contact; or (e) any dispute between you and any other User, Counterparty, or third party arising from your use of the Service. The Company reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with the Company’s defense of such claim.

The Company may suspend or terminate your Account or access to the Service, in whole or in part, at any time, with or without notice, and with or without cause, including but not limited to where the Company believes you have violated these Terms, engaged in Prohibited Conduct under Section 15, or created risk to the Company, another User, or a third party. You may stop using the Service and, where a deletion mechanism is available, request deletion of your Account at any time, subject to the Company’s data-retention obligations described in the Privacy Policy. Sections that by their nature should survive termination — including without limitation Sections 5, 6, 9, 10, 12, 13, 16, 18, 19, 20, 23, and 26 — will survive any termination or expiration of these Terms.

The Company reserves the right, at its sole discretion and at any time, to modify, suspend, or discontinue the Service or any feature of it, in whole or in part, with or without notice, and without liability to you. The Company also reserves the right to update or modify these Terms at any time, in its sole discretion. Where a change is material, the Company will use reasonable efforts to provide notice through the Service or by email to your Account address; however, your continued access to or use of the Service after any change to these Terms takes effect constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. The then-current version of these Terms will always be available at sistersafe.io/terms.

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, formation, or validity (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, that cannot be resolved through good-faith negotiation within thirty (30) days shall be referred to and finally resolved by arbitration administered in Dubai, United Arab Emirates, in accordance with the arbitration rules of a recognized Dubai-based arbitration institution then in effect, by a single arbitrator, in the English language. The arbitration award shall be final and binding on the parties. Notwithstanding the foregoing, the Company may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information, and either party may bring an individual claim in small-claims court where permitted. You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as part of a class, consolidated, or representative action, to the extent permitted by Applicable Law.

The Company shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including without limitation acts of God, natural disaster, pandemic, epidemic, war, terrorism, riot, civil unrest, governmental action or restriction, labor dispute, internet or telecommunications failure, power outage, failure of a third-party service provider, or cyberattack.

Entire Agreement. These Terms, together with the Privacy Policy and any other policy expressly incorporated by reference, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous agreements on that subject.

Severability. If any provision of these Terms is held unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No Waiver. The Company’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of that or any other right or provision.

Assignment. You may not assign or transfer these Terms or any rights or obligations under them without the Company’s prior written consent. The Company may freely assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

Language. These Terms are provided in English and Thai for the convenience of Users. In the event of any conflict or inconsistency between the English and Thai versions, the English version shall prevail to the fullest extent permitted by Applicable Law.

Notices. The Company may provide notices to you through the Service, by email to your Account address, or by posting on the website. You may send notices to the Company at the contact information in Section 26.
